Understanding Florida’s No-Fault Insurance: What PIP Covers After a Car Accident

If you’ve been in a car accident in Florida, you’ve probably heard the term “no-fault state” thrown around, but a lot of people aren’t quite sure what it actually means for their claim. Here’s a straightforward breakdown of how Florida’s no-fault system works and what it means for your recovery after a crash.

What “No-Fault” Actually Means

In a no-fault state like Florida, your own insurance company pays for your initial medical bills and lost wages after a car accident, regardless of who caused the crash. This coverage is called Personal Injury Protection, or PIP, and Florida law requires drivers to carry at least $10,000 in PIP coverage.

The idea behind no-fault insurance is to get medical bills paid quickly without waiting for fault to be determined, which can otherwise take months. In practice, though, $10,000 doesn’t go very far when a serious accident is involved, which is where things get complicated.

What PIP Covers

PIP generally covers 80% of reasonable and necessary medical expenses and 60% of lost wages, up to your policy’s limit. It applies no matter who caused the accident, but it comes with strict requirements, including a rule that you must seek medical treatment within 14 days of the accident or risk losing PIP benefits entirely.

When You Can Step Outside the No-Fault System

Florida’s no-fault system isn’t absolute. If your injuries meet a certain threshold, generally significant and permanent injury, permanent scarring or disfigurement, or death, you can step outside the no-fault system and pursue a claim directly against the at-fault driver for damages beyond what PIP covers, including pain and suffering.

This is often where the real compensation in a serious accident comes from, since PIP alone rarely covers the full cost of a significant injury. It’s also where having an attorney matters most, since insurance companies frequently dispute whether an injury meets the legal threshold to pursue additional damages.

Uninsured and Underinsured Motorist Coverage

Because Florida doesn’t require drivers to carry bodily injury liability coverage in the same way many states do, a surprising number of drivers on the road carry minimal or no liability coverage. Uninsured/underinsured motorist (UM/UIM) coverage, which you can add to your own policy, protects you in situations where the at-fault driver doesn’t have enough insurance to cover your damages. If you don’t already carry this coverage, it’s worth talking to your insurance agent about adding it.

The 14-Day Rule Trips Up a Lot of People

One of the most common and costly mistakes after a car accident is waiting too long to seek treatment. Adrenaline can mask pain in the hours and days after a crash, but if you don’t get evaluated within 14 days, you can lose access to PIP benefits altogether, even if your injuries turn out to be serious.
