Distracted Driving Accidents in Florida: Proving Fault When a Phone Was Involved

Distracted driving has become one of the leading causes of serious car accidents across Florida, and Tampa Bay is no exception. A driver glancing at a text message for even a few seconds can travel the length of a football field without watching the road. When that inattention causes a crash, proving what really happened is often the key to a successful claim.

What Counts as Distracted Driving

Distracted driving covers far more than just texting. It includes talking on the phone, adjusting a GPS or entertainment system, eating while driving, reaching for something in the car, or even talking with passengers. Florida’s texting while driving law makes it illegal to manually type or send text-based communications while operating a vehicle, and it’s a primary offense, meaning an officer can pull a driver over for it alone.

Why These Cases Can Be Harder to Prove

Unlike a driver who runs a red light on camera, distracted driving often happens without an obvious witness. The driver responsible has no incentive to admit they were on their phone, and unless there’s a citation or an admission, it can come down to circumstantial evidence.

Evidence That Can Establish Distraction

  • Cell phone records, which can sometimes be obtained through the discovery process to show call, text, or data activity at the time of the crash
  • Witness statements describing the other driver’s behavior before impact
  • Traffic camera or nearby business surveillance footage
  • The police report, including any citations issued
  • Physical evidence at the scene, such as a lack of braking or skid marks, which can suggest the driver never saw the hazard coming

Comparative Negligence Still Applies

As with other Florida accident claims, comparative negligence rules mean your compensation can be reduced if you’re found partially at fault, and barred entirely if you’re found more than 50% responsible. Insurance companies handling distracted driving claims will often look for any reason to argue the crash wasn’t solely caused by their driver’s inattention, which is why a thorough investigation matters.

Common Injuries From Distracted Driving Crashes

Because distracted drivers often fail to brake or react at all before impact, these accidents can involve significant force. Whiplash, fractures, traumatic brain injuries, and spinal injuries are common, along with the emotional toll of a crash that, in hindsight, was entirely preventable.

What You Can Recover

A successful claim can include medical expenses, lost wages, vehicle repair or replacement, and compensation for pain and suffering, along with future damages if injuries result in lasting limitations.
