Assault and Battery Charges in Florida: What You’re Up Against

Assault and battery charges get thrown around casually in everyday conversation, but under Florida law, they’re two distinct crimes with very different elements, and the consequences can be serious even for a first offense. If you’re facing either charge, understanding what the state has to prove can help you understand your options.

Assault vs. Battery: They’re Not the Same Thing

A lot of people assume assault means physical contact occurred, but under Florida law, assault is actually the threat of violence, an intentional, unlawful threat to do violence to another person, combined with an apparent ability to carry it out, that creates a well-founded fear in the other person that violence is about to happen. No physical contact is required.

Battery, on the other hand, involves actual physical contact, either intentionally striking someone or intentionally touching them against their will in a way the law considers offensive or provocative.

How the Charges Escalate

Simple assault is generally a second-degree misdemeanor, while simple battery is a first-degree misdemeanor. Both can escalate significantly based on the circumstances:

  • Aggravated assault involves a deadly weapon or the intent to commit a felony, and is a third-degree felony
  • Aggravated battery involves great bodily harm, permanent disability, use of a deadly weapon, or an offense against someone the defendant knew was pregnant, and is a second-degree felony
  • Charges can also be enhanced if the alleged victim is a law enforcement officer, elderly person, or in certain other protected categories

Common Defenses

Every case depends on its specific facts, but frequently raised defenses include self-defense or defense of others, lack of intent, mistaken identity, and disputes over whether the alleged victim’s account matches the physical evidence. Florida’s “Stand Your Ground” law can also be relevant in cases where a person reasonably believed force was necessary to protect themselves or someone else.
