Leaving the Scene of an Accident: What Happens After a Hit and Run in St. Petersburg

Getting hit by a driver who speeds off is one of the most frustrating experiences a crash victim can go through. You’re left dealing with injuries, vehicle damage, and mounting bills, often with no idea who’s responsible. Here’s what you need to know if you’ve been the victim of a hit and run in St. Petersburg, and what happens if you’re the one accused of leaving the scene.

If You’re the Victim

Florida law requires drivers involved in any accident that causes injury or property damage to stop and exchange information. When a driver flees, it can feel like your case is over before it starts. It isn’t.

Steps that can make a real difference include:

  • Calling 911 immediately so the accident is officially documented
  • Writing down or photographing any part of the license plate, vehicle description, or direction of travel you managed to see
  • Asking nearby businesses or homes if they have security cameras facing the road
  • Checking with witnesses who may have captured more detail than you did in the moment

Even if the driver is never identified, you may still have options. Most Florida auto policies include uninsured motorist coverage, which can apply in hit and run cases, and your own Personal Injury Protection (PIP) coverage generally applies regardless of fault. An attorney can help you sort through what coverage is available and how to pursue it.

If Police Do Identify the Driver

When law enforcement is able to track down the driver, either through cameras, witnesses, or vehicle debris left at the scene, it strengthens both a criminal case against them and your civil claim for damages.

If You’re Accused of Leaving the Scene

Leaving the scene of an accident is a serious criminal charge in Florida, and the severity depends heavily on whether anyone was injured or killed. Leaving the scene of a crash involving only property damage is typically a second-degree misdemeanor. If the accident caused injury, it becomes a felony, and if it caused death, the penalties increase dramatically, including significant prison time.

Common defenses in these cases include disputing that the person was aware an accident occurred (which does happen, particularly in low-impact collisions or ones involving stationary objects), mistaken identity, or challenging how the vehicle was identified.

Why Timing Matters on Both Sides

For victims, evidence like camera footage and witness memory fades fast. For anyone facing charges, an early conversation with an attorney can shape how the case is handled from the very beginning, including whether charges might be reduced or an alternative resolution is possible.
