Why Truck Accident Cases Are Different — And Why That Matters for Your Claim

Why Truck Accident Cases Are Different — And Why That Matters for Your Claim

If you’ve been involved in a collision with a semi-truck or commercial vehicle in the Tampa Bay area, you may already sense that something about the situation feels different from a typical car accident. You’re right — and that difference matters enormously when it comes to protecting your rights and recovering fair compensation.

The Stakes Are Higher

A fully loaded commercial truck can weigh up to 80,000 pounds — roughly 20 times the weight of an average passenger car. When a vehicle of that size and momentum is involved in a crash, the results are often catastrophic: severe or permanent injuries, totaled vehicles, and in the worst cases, fatalities. The physical damage alone makes these cases more complex than standard auto accidents.

Multiple Parties May Be Responsible

In a typical two-car accident, liability usually comes down to one driver or the other. Truck accident cases are far more layered. Depending on the circumstances, responsible parties may include:

  • The truck driver — for negligent or impaired driving, hours-of-service violations, or distracted driving
  • The trucking company — for inadequate driver training, pressure to meet unrealistic delivery schedules, or negligent hiring
  • The cargo loading company — if improperly secured cargo contributed to the crash
  • The truck’s manufacturer — if a mechanical defect such as brake failure played a role
  • A maintenance provider — if required inspections or repairs were skipped

Identifying every responsible party is critical — and it’s one of the most important things an experienced truck accident attorney does from day one.

Federal and Florida Regulations Apply

Commercial trucks operating in Florida are governed by both state law and federal regulations set by the Federal Motor Carrier Safety Administration (FMCSA). These rules cover:

  • Hours of service — how long a driver can operate before mandatory rest
  • Blood alcohol limits — truck drivers are held to a stricter .04 BAC limit, compared to .08 for regular drivers
  • Minimum following distance — Florida law requires trucks to maintain at least 300 feet of space from the vehicle ahead
  • Vehicle weight and size limits
  • Required inspections, maintenance logs, and driver qualification files

When any of these rules are violated, it can establish negligence — but only if the right evidence is gathered quickly.

Evidence Disappears Fast

This is one of the most urgent realities of truck accident cases. Commercial trucks are equipped with electronic logging devices (ELDs), GPS systems, and sometimes dashcams — all of which generate data that can be critical to your case. However:

  • Trucking companies are only required to retain certain records for limited periods
  • Electronic data can be overwritten or “lost” if not formally preserved
  • Trucking companies often have attorneys and insurance adjusters on the scene quickly — working in their interests, not yours

An attorney can send a legal hold letter to the trucking company immediately, demanding preservation of black box data, driver logs, inspection records, and communication records. Every day without that protection is a day that evidence can disappear.

The Insurance Dynamics Are Different

Commercial trucking companies carry much larger insurance policies than individual drivers — often in the millions of dollars. That sounds like good news, but it also means their insurers have far more resources to fight your claim, minimize your payout, or shift blame. Having an attorney who understands commercial trucking litigation levels the playing field.

What to Do After a Truck Accident in Tampa Bay
  • Call 911 and seek immediate medical attention, even if you feel okay
  • Do not speak with the trucking company’s insurance adjuster before consulting an attorney
  • Document everything at the scene — photos, witness names, truck company name and DOT number
  • Preserve any dashcam footage from your own vehicle
  • Contact a truck accident attorney as soon as possible
