Drowsy Truckers and Florida Roads: How Hours-of-Service Violations Cause Accidents

Long-haul trucking is demanding work, and the pressure to meet delivery deadlines can push drivers far beyond safe limits. Fatigued driving is one of the leading causes of serious truck accidents — and when it happens on Tampa Bay’s busy corridors like I-275, I-4, and U.S. 19, the consequences can be devastating.

What Are Hours-of-Service Rules?

The Federal Motor Carrier Safety Administration (FMCSA) sets strict limits on how long commercial truck drivers can operate before taking mandatory rest. Key rules include:

  • 11-hour driving limit — drivers may not operate a commercial vehicle for more than 11 hours after 10 consecutive hours off duty
  • 14-hour window — drivers may not drive beyond the 14th hour after coming on duty, even if they haven’t driven the full 11 hours
  • 30-minute rest break — required after 8 cumulative hours of driving
  • 60/70-hour weekly limit — drivers cannot exceed 60 hours of driving in 7 days or 70 hours in 8 days
  • Sleeper berth provisions — drivers using a sleeper cab must take a qualifying rest period before resuming

These rules exist for good reason: studies consistently show that a truck driver who has been awake for 18 hours has impairment levels similar to a driver with a .08 blood alcohol level.

How Violations Happen

Hours-of-service violations are more common than most people realize. They can occur because:

  • Trucking companies pressure drivers to make deliveries faster than regulations allow
  • Drivers falsify their electronic logging device (ELD) records or paper logs
  • Companies create unrealistic schedules that can only be met by cutting rest
  • Independent owner-operators push themselves beyond legal limits to maximize income

When a tired driver causes an accident, both the driver and the trucking company may be liable — especially if the company knew about or encouraged the violations.

Signs That Fatigue Played a Role in Your Accident

Crash investigators and attorneys look for certain indicators that driver fatigue was a factor:

  • The accident occurred in the early morning hours (2 a.m.–6 a.m.) or mid-afternoon — peak fatigue windows
  • There are no skid marks, suggesting the driver never braked
  • The truck drifted across lane lines before impact
  • Witness accounts describe the truck traveling erratically or at inconsistent speeds
  • ELD data shows the driver had been on duty longer than legally permitted
Why This Evidence Must Be Preserved Immediately

Electronic logging device data, trip records, dispatch logs, and communication records between the driver and the company are all potentially critical evidence in a fatigue-related truck accident case. However, this data is not kept indefinitely. Trucking companies are only required to retain driver logs for six months — and electronic records can be overwritten even sooner.

An attorney can issue a litigation hold notice to the trucking company demanding that all records be preserved. This step needs to happen as quickly as possible after the accident.
