What Happens If You’re Hit by an Uninsured Driver in Florida?

What Happens If You’re Hit by an Uninsured Driver in Florida?

Car accidents are stressful under any circumstances. When the at-fault driver does not have insurance, the situation becomes even more complicated.

Florida’s Insurance System

Florida operates under a no-fault insurance system. This means your own insurance — specifically Personal Injury Protection (PIP) — covers your initial medical expenses regardless of who caused the accident. PIP covers 80% of medical costs up to $10,000. However, that limit may not be enough for serious injuries, leaving you responsible for the remainder.

What If the Other Driver Has No Insurance?

If the at-fault driver is uninsured, you may have several options:

1. Uninsured Motorist (UM) Coverage
If you carry uninsured motorist coverage, it can help pay for medical expenses beyond PIP, lost wages, and pain and suffering. Importantly, Florida does not require UM coverage — which means many drivers don’t have it and don’t realize it until after an accident.

2. Filing a Lawsuit
You may be able to pursue a claim directly against the at-fault driver. However, many uninsured drivers have limited financial resources, which can affect recovery.

3. Other Potential Sources of Compensation
In some cases, additional parties may share liability, such as:

  • Employers (if the driver was working at the time)
  • Vehicle owners
  • Third parties who contributed to the accident
Steps to Take After the Accident

1. Call the Police
A police report is essential, especially when dealing with uninsured drivers.

2. Gather Evidence
Document the scene, vehicle damage, and any injuries.

3. Seek Medical Care
Even minor injuries should be evaluated and documented promptly.

4. Notify Your Insurance Company
Report the accident promptly and ask specifically about UM coverage.

5. Speak With an Attorney
Uninsured driver cases often involve complex insurance issues and multiple avenues for compensation.

Protecting Yourself in the Future

Uninsured motorist coverage is optional in Florida but highly recommended. Review your policy today — and ask your insurer specifically whether you have UM coverage and at what limit.
