What Happens After a DUI Arrest in Pinellas County

A DUI arrest can feel like it's happening in fast forward. One minute you're pulled over, and the next you're being booked, and you're not entirely sure what comes next or how serious the consequences might be. If you've been arrested for DUI in Pinellas County, here's a clear walkthrough of the process and what's at stake.

The Arrest and Booking Process

After a DUI arrest, you'll typically be taken to jail for booking, which includes fingerprinting, photographs, and a bond hearing. Depending on the circumstances (whether this is a first offense, whether there was an accident involved, or whether your blood alcohol level was significantly over the legal limit) bond amounts and conditions can vary widely.

The 10-Day Rule for Your License

One of the most time-sensitive parts of a DUI case involves your driver's license. Under Florida law, you generally have only 10 days from the date of arrest to request a formal review hearing with the Department of Highway Safety and Motor Vehicles (DHSMV) to challenge the automatic suspension of your license. Miss that window, and the suspension takes effect automatically, separate from whatever happens in the criminal case. This is one of the biggest reasons to talk to an attorney immediately rather than waiting.

Criminal Charges and Court Process

Separate from the license suspension, you'll face the criminal case itself. A first-time DUI in Florida is typically a misdemeanor, but penalties can still include fines, probation, mandatory DUI school, community service, and in some cases jail time, especially if your blood alcohol content was high or a minor was in the vehicle. Prior DUI convictions, accidents involving injury, or property damage can escalate the charges significantly.

Common Defenses in DUI Cases

Every case is different, but some of the issues that come up frequently include:

  • Whether the traffic stop itself was legally justified
  • Whether field sobriety tests were administered correctly
  • Whether breathalyzer or blood test equipment was properly calibrated and maintained
  • Whether proper procedure was followed during the arrest and testing

An experienced DUI attorney will review the arrest report, dashcam and bodycam footage, and testing records line by line to see where the state's case may have weaknesses.

Why Acting Quickly Matters

Between the 10-day license review deadline and the importance of preserving evidence early, the first days after a DUI arrest are critical. Waiting to get legal representation can mean losing options that were available right after the arrest.
