Reckless Driving Charges in Florida: More Serious Than a Traffic Ticket

Getting pulled over for speeding usually means a fine and a few points on your license. Reckless driving is a different matter entirely. In Florida, reckless driving isn’t a traffic infraction, it’s a criminal offense that can result in a permanent record, jail time, and a license suspension. If you’ve been charged, here’s what you’re actually facing.

What Separates Reckless Driving From a Regular Traffic Ticket

Florida law defines reckless driving as operating a vehicle with willful or wanton disregard for the safety of persons or property. That’s a higher standard than ordinary careless driving, which is a civil infraction. Prosecutors and officers often point to excessive speed, aggressive lane changes, racing, or evasive maneuvers as evidence of the “willful and wanton” standard, but the specific facts of each stop matter enormously in how a case plays out.

Potential Penalties

A first offense for reckless driving is typically a second-degree misdemeanor, punishable by up to 90 days in jail and a fine. If the reckless driving caused property damage or injury, the charge becomes a first-degree misdemeanor, with penalties increasing to up to a year in jail. If it results in serious bodily injury, it becomes a third-degree felony. A second or subsequent reckless driving conviction also carries enhanced penalties.

Beyond the criminal penalties, a conviction adds points to your license and stays on your permanent record, which can affect insurance rates for years and, depending on your profession, your employment.

Reckless Driving vs. DUI

Reckless driving charges sometimes appear alongside, or as a lesser alternative to, a DUI charge. Prosecutors and defense attorneys occasionally negotiate a DUI down to reckless driving, sometimes informally referred to as a “wet reckless,” when the evidence for impairment is weaker than the evidence for reckless operation of the vehicle. Understanding this dynamic is one reason it helps to have an attorney who’s experienced with both types of charges.

Common Defenses

  • Challenging the officer’s characterization of your driving as “willful and wanton” rather than merely careless
  • Disputing the accuracy of speed estimates or dashcam interpretations
  • Questioning whether the stop itself was legally justified
  • Presenting evidence of road, weather, or traffic conditions that contradict the state’s account

Why It’s Worth Fighting a Reckless Driving Charge

Because reckless driving is a criminal offense rather than a simple ticket, treating it like “just a traffic thing” can be a costly mistake. A conviction follows you in a way that a speeding ticket never will.
